These Terms of Service ("Terms") govern your use of howismy.site (the "Service"), operated by howismy.site ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. What the Service does

howismy.site analyzes how a business is represented across AI search platforms including ChatGPT, Claude, Gemini, and Perplexity, and provides estimated visibility data for Google AI Overviews and Microsoft Copilot where no public API exists. The Service generates a visibility score, competitive comparison, and optional recommendations based on data retrieved from these platforms at the time of the audit.

2. AI-generated content

Audit results, scores, and recommendations are generated using artificial intelligence based on real-time queries to third-party AI platforms. While we design our methodology to be accurate and grounded in actual platform responses, AI-generated content can be imperfect, may change between runs of the same audit, and does not constitute professional business, legal, or marketing advice. Recommendations are not produced by a human consultant reviewing your specific business.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Payments and credits

• Audit credits purchased through the Service do not expire.
• The Agency subscription renews monthly and can be cancelled at any time; cancellation takes effect at the end of the current billing period.
• All sales are final. We do not offer refunds for dissatisfaction with audit results, scores, or recommendations. Refunds may be issued at our discretion in cases of genuine technical failure where no deliverable was provided.

5. Agency plan and white-label use

Agency plan subscribers may apply their own branding to client-facing dashboards and reports generated through the Service, and may share these with their own clients under their own brand name. You remain responsible for the accuracy of any claims you make to your clients about the Service's capabilities or methodology.

6. Acceptable use

You agree not to misuse the Service, including but not limited to: attempting to circumvent audit credit limits, using the Service to harass or defame any business, scraping or reselling raw audit data outside the intended Agency white-label use case, or attempting to interfere with the Service's operation.

7. Data and audit results

Audit results are based on publicly available information and the outputs of third-party AI platforms at the time the audit was run. We do not guarantee the accuracy, completeness, or permanence of any AI platform's response, and results may differ if the audit is run again at a later date as AI platforms update their own data and models.

8. Disclaimer of warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that using the Service or implementing its recommendations will result in any particular outcome, including but not limited to increased visibility, traffic, leads, or revenue.

9. Limitation of liability

To the maximum extent permitted by law, howismy.site is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including business decisions made based on audit results or recommendations.

10. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
